Welcome to PixelNiches.

These Terms of Use (“Terms”) govern your access to and use of PixelNiches.com and its related services, features, boards, Spots, accounts, subscriptions, and content.

By accessing or using PixelNiches, you agree to these Terms. If you do not agree with these Terms, you must not use the service.

1. About PixelNiches

PixelNiches is an interactive, visual directory platform that organizes user submitted listings into niche based boards.

Users may create accounts, claim Spots, submit listing information, interact with other Spots, and purchase additional board space through paid subscriptions.

PixelNiches is a directory and publishing platform. We do not operate, control, or endorse the external websites linked by users.

2. Eligibility

You must provide accurate information when creating or using an account.

You must be legally capable of entering into a binding agreement under the laws applicable to you.

PixelNiches is not intended for children under 13.

Where applicable law requires parental or guardian involvement for a minor to use a service or enter into a transaction, that requirement applies.

3. Your Account

You are responsible for maintaining the security of your account and for activity carried out through your account.

You must not:

• Create an account using false or misleading information
• Impersonate another person or organization
• Access another user’s account without permission
• Share account credentials in a way that compromises account security
• Use the platform to circumvent Spot or subscription limitations

We may suspend or terminate accounts involved in abuse, fraud, security violations, or other violations of these Terms.

4. Spots and User Submitted Content

A “Spot” is a location on a PixelNiches board associated with a user submitted listing.

Users are solely responsible for the content they submit, including:

• Names and titles
• Descriptions
• Images and logos
• Website URLs
• Promotional or other listing information

You represent and warrant that you have the necessary rights and permissions to submit and publicly display the content you upload.

You are also responsible for ensuring that your Spot and linked website comply with applicable laws.

PixelNiches does not endorse, guarantee, or take responsibility for the accuracy, legality, availability, safety, or quality of user submitted content or third party websites.

5. License to Display Your Content

You retain ownership of content you submit to PixelNiches.

By submitting content, you grant PixelNiches a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, optimize, and otherwise process that content as reasonably necessary to operate, maintain, and promote the PixelNiches service.

This license does not transfer ownership of your content to PixelNiches.

You may remove or change your Spot content subject to the functionality of the service and any applicable subscription terms.

6. Prohibited Content and Activities

PixelNiches is intended for lawful, useful, and appropriate directory listings.

You may not use PixelNiches to publish, promote, distribute, or link to content or services that include:

• Pornography or sexually explicit material
• Hate speech or content promoting hatred or discrimination against protected groups
• Illegal goods, illegal services, or unlawful activities
• Content that promotes or facilitates criminal activity
• Malware, phishing, scams, or other malicious activity
• Content that infringes copyrights, trademarks, or other intellectual property rights
• Content that violates another person’s privacy, publicity, or other legal rights
• Fraudulent, deceptive, or misleading listings
• Spam or mass unsolicited promotional activity
• Content designed to manipulate votes, clicks, or other platform activity through fraudulent means

You must not use PixelNiches to interfere with the operation or security of the platform.

7. Copyright and Intellectual Property Complaints

If you believe content displayed on PixelNiches infringes your copyright, trademark, or other intellectual property rights, please Contact Us.

Please provide enough information for us to identify the material and understand the basis of your complaint.

We may remove or restrict access to content while reviewing a complaint.

Submitting a complaint does not guarantee that content will be removed.

8. Moderation and Removal Rights

PixelNiches reserves the right to review, reject, remove, disable, edit, relocate, resize, or modify any Spot or user submitted content at our discretion.

We may take action without prior notice when we believe content:

• Violates these Terms
• Violates applicable law
• Infringes another person’s rights
• Creates security or legal risks
• Is misleading, fraudulent, abusive, or inappropriate
• Harms the integrity or operation of PixelNiches

When a Spot or account violates these Terms, we may suspend or terminate access without notice.

Where a paid Spot or subscription is removed or terminated because of a violation of these Terms, you may lose access to the associated Spot and subscription without a refund, except where a refund is required by applicable law.

PixelNiches may also take action against content or accounts that we reasonably believe create a risk to users, the platform, or third parties.

9. Free Spots

PixelNiches may offer qualifying users free Spots.

The current free allowance provides:

Up to three 1×1 Spots per user, across three different boards.

This means that a user may claim one free 1×1 Spot on each of up to three different niche boards.

The free allowance is limited to three boards per user and does not provide three free Spots on the same board.

PixelNiches may change eligibility requirements or future free Spot policies, subject to applicable law. Existing rights already granted for an active Spot will be handled according to the applicable terms at the time of the change.

10. Paid Spots and Subscriptions

Users may purchase additional board space through paid subscriptions.

Premium Spots may be selected using multiple square tiles, with pricing based on the number of tiles included in the Spot and the billing period selected.

Available plans, pricing, billing intervals, and other commercial terms are displayed during the purchase process and may change from time to time.

Unless otherwise stated at checkout, subscriptions renew automatically according to the selected billing interval until canceled.

11. Subscription Cancellation

You may cancel an active subscription according to the cancellation functionality provided by PixelNiches or the applicable payment processor.

When a subscription is canceled, the associated paid Spot remains active until the end of the current billing period already paid for.

After the current billing period ends, the subscription will not renew and the associated premium Spot may become inactive or otherwise unavailable.

Canceling a subscription does not automatically entitle you to a refund for the unused portion of the current billing period, except where a refund is required by applicable law or expressly provided by PixelNiches.

12. Payments

Payments are processed through third party payment providers such as Stripe and/or PayPal.

PixelNiches does not intentionally store complete credit card numbers on its own servers.

Payment processors may apply their own terms, policies, verification requirements, fees, and fraud prevention procedures.

You are responsible for providing accurate billing information and ensuring that your chosen payment method is authorized for the transaction.

13. Prices and Taxes

Prices displayed on PixelNiches are stated in the currency shown during checkout.

Applicable taxes, fees, or other charges may apply depending on your location and the payment transaction.

PixelNiches may change pricing for future purchases or renewal periods. Any required notice of a price change will be provided as required by applicable law.

14. Upvotes and Favorites

PixelNiches may provide community features such as Spot upvotes and favorites.

You must not manipulate these systems through fake accounts, automated activity, bots, scripts, purchased engagement, or other fraudulent methods.

PixelNiches may remove fraudulent votes, favorites, or other engagement data and may restrict accounts involved in manipulation.

Upvotes and favorites are platform features and do not create ownership rights in a Spot.

15. Outbound Links

Spots may contain links to external websites.

PixelNiches does not control or guarantee those websites and is not responsible for:

• Their content
• Products or services offered by them
• Privacy practices
• Security
• Availability
• Accuracy
• Transactions between you and those websites

Visiting an external website is at your own discretion and risk.

The presence of a Spot or link on PixelNiches does not constitute an endorsement, recommendation, sponsorship, or affiliation with the linked website unless explicitly stated by PixelNiches.

16. Availability of the Service

We work to keep PixelNiches available and functional, but we do not guarantee that the service will always be uninterrupted, secure, error-free, or available.

We may temporarily suspend or modify parts of the service for maintenance, security, upgrades, technical issues, or other reasons.

Features may be changed, discontinued, or replaced over time.

17. No Guarantee of Traffic or Results

PixelNiches provides directory exposure and related platform functionality.

We do not guarantee:

• A specific number of visitors
• Clicks or impressions
• Leads or sales
• Search engine rankings
• Revenue
• Conversion rates
• Any particular business result

Paid placement does not guarantee a particular amount of traffic or engagement.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, PixelNiches is provided on an “as available” and “as is” basis.

We make no warranties regarding the completeness, accuracy, reliability, availability, or suitability of the platform or user submitted content.

Nothing in these Terms excludes or limits rights or protections that cannot lawfully be excluded or limited under applicable law.

19. Limitation of Liability

To the maximum extent permitted by applicable law, PixelNiches and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service.

This includes, where permitted by law, losses resulting from:

• User submitted content
• External websites
• Interrupted service
• Lost data
• Lost revenue or business opportunities
• Unauthorized access
• Errors or technical failures
• Actions taken against user content under these Terms

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to defend and hold harmless PixelNiches and its owners, operators, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• Your use of PixelNiches
• Content you submit
• Your violation of these Terms
• Your violation of applicable law or third party rights
• Your websites, products, or services linked through a Spot

21. Termination

You may stop using PixelNiches at any time.

PixelNiches may suspend or terminate your account or access to the service when we reasonably determine that you have violated these Terms, applicable law, or otherwise created a security, legal, or operational risk.

We may also terminate or discontinue the service as a whole.

Termination does not affect rights or obligations that by their nature should survive termination.

22. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we may provide notice through the website or other appropriate means where required by law.

Your continued use of PixelNiches after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

23. Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles, except where mandatory laws applicable to you provide otherwise.

Any dispute will be handled by the courts having jurisdiction under applicable law.
